MEMPHIS, Tenn. - Lawyers for a Memphis gynecologist have filed motions in response to a 46-count indictment against him.

Dr. Sanjeev Kumar's lawyers filed a motion to dismiss the case for vindictive prosecution and a motion asking for a status conference to discuss a new trial date.

This follows a new indictment that charges Kumar with 32 counts related to reusing single-use medical devices along with 10 counts for healthcare fraud and four counts for performing unnecessary surgeries. The indictment came down two weeks after a judge threw half of the previous charges out.

Kumar is set to stand trial Dec. 1.
