BIRMINGHAM, Ala. ( WBRC ) - A law that took effect Oct. 1, 2024, establishes procedures for how law enforcement agencies handle body camera video requests, including when footage can be released.
The legislation was written by Alabama State Rep. Juandalynn Givan. The law designates the agency with physical custody of body camera video as the “custodial,” though custody can be transferred.
This occurred over the summer when the Homewood Police Department released body camera video from the Jabari Peoples case to the Alabama Law Enforcement Agency.
“That happens in cases where there are independent investigations where the law enforcement agency can say to the prosecutors ‘I’m passing it on to you’,” Givan said.
