A Boston federal judge today ordered Mirian Ximena Abarca Tixe freed immediately from the 8x10 windowless basement room with no bed or sink - or access to her lawyer - that ICE stuck her in last week after returning her from the Texas prison it had shoved her in without telling anybody.
In an order issued after a hearing on her case this afternoon, US District Court Judge George O'Toole wrote:
Respondent Patricia Hyde, Acting Director of the New England Field Office of U.S. Immigration and Customs Enforcement, is therefore ORDERED to release the petitioner from her confinement immediately.
The ruling does not stop ICE from continuing to try to deport Abarca Tixe, her husband and their young child, but they can't just lock her up indefinitely.
