TUCSON, Ariz. (KVOA) - The Tucson Police Department is investigating a fatal incident that occurred at a convenience store on Friday.
According to TPD, officers responded to a report of an unresponsive male at a convenience store near First Avenue and Limberlost Drive on Nov. 21 around 4:15 a.m.
Emery Kirk, 46, was found unresponsive at the location. Kirk was transported to the hospital with life-threatening injuries, where he later died on Nov. 22.
TPD said Kirk attempted to take cigarettes from the store without paying, after going behind the counter. A bystander intervened, leading to a physical fight where Kirk reportedly lost consciousness.
The 31-year-old male involved in the fight called 9-1-1 to report the incident.
The Homicide Unit is now handling the investigation.
