TOLEDO, Ohio — An appeals court has granted a new trial to the man sentenced to life in prison without parole for the murder of a Sylvania 3-year-old in 2022.
Overturning the judgment from the Lucas County Court of Common Pleas, the Sixth District Court of Appeals on Tuesday ordered the conviction of Michael Kitto, 34, be vacated after finding "substantial justice has not been done."
Kitto's defense claims multiple errors were made during his initial trial and are grounds for his case to be revisited, according to the appeals court's ruling.
Kitto was sentenced in July of last year on aggravated murder, murder and endangering children charges for the death of Declan Hill, who was his girlfriend's son.
