BUFFALO, N.Y. — The owner of 110 and 118 South Park Ave, Darryl Carr, had his lawsuit against the city of Buffalo reinstated after the Appellate Division, Fourth Department reversed a lower courts dismissal of that lawsuit.
After a fire in June 2024 ravaged the two properties, Carr sought an emergency demolition permit by the city.
The city's Department of Permit & Inspection Services denied the request, saying that Carr must go through the Preservation Board for such a permit.
Carr argued that city code allowed him to demo the buildings, because they were wooden structures and the damage to the property from the fire surpassed 50% of the estimated value of them.
The Dept. of Permits & Inspections disagreed, citing that they were not wooden structures, but in fact timber structures,
