MINGO COUNTY, W.Va. (WSAZ) - Judge Joshua Butcher has granted defendants’ motion for a mistrial due to juror misconduct in a case against a man charged with the murder of West Virginia State Trooper Cory Maynard in June of 2023.

Timothy Kennedy was indicted on charges of first degree murder, first degree robbery, one count of attempting to disarm a police officer, and two counts of attempted murder in January of 2024.

They will be setting a new date soon for the trial to begin next term, which begins early next month.

As of right now, the trial will still happen in Mingo County, and they will have jury selection with a new jury pool during the next term.

Theoretically, the judge could still rule on the motion to move jurisdictions before the next date.
