The Alabama Supreme Court will hear oral arguments in a case that has already been heard by two lower courts.
Former Decatur police officer Mac Marquette is charged with murder for the September 2023 shooting death of Stephen Perkins. Marquette claims self-defense, but the Morgan County Circuit Court denied that claim. The case was then taken up by the Alabama Court of Criminal Appeals, which also rejected the claim.
On Tuesday, the Alabama Supreme Court set an oral argument for the case. It will be heard at 10 a.m. on Jan. 28, 2026, at the University of Alabama.
Attorneys for Marquette are expected to ask a judge to delay his scheduled Jan. 26 trial in Morgan County.
Marquette is considered innocent until proven guilty.
