MEDINA, Ohio — A Medina County judge is mulling whether to appoint a special prosecutor to oversee the case of a Portage County sheriff’s deputy who is charged with attacking a man he mistakenly believed was an undocumented immigrant.

Defense attorneys for Daniel Lajack argued that Medina County Prosecutor Forrest Thompson and his office should be kicked off the case because Thompson’s personal involvement could create a conflict of interest in the case and potentially prejudice Lajack.

Common Pleas Judge Joyce Kimbler said during a short hearing on Thursday that she would rule on the issue based on written arguments and make a decision at a later time.
