Almost a month after a jury found Tesla partially to blame for a crash that killed a woman and injured her boyfriend in Key Largo back in 2019, the company on Friday filed a motion to appeal.

Tesla is asking for the unanimous verdict from the August trial to be thrown out or for there to be a new trial, and the company also wants the roughly $243 million they owe towards the family to be reduced or scrubbed altogether.

In the appeal, they state that the blame is solely the driver’s, and that imposing liability on the technology, in this case the Model S’ Autopilot feature, “Will only deter innovation, confound consumer expectations, and lead manufacturers to abandon safety enhancements for fear of being subjected to large punishments when a driver misuses their product.”
