NEBRASKA CITY, Neb. —

An Otoe County judge ruled a man who hit and killed a child in Nebraska City does not need to wear an alcohol monitoring device any more.

Vernon Christiansen, 59, hit a 6-year-old as he was driving through an alley on July 16.

The child died at the scene and officers said they found an open alcohol container in Christiansen's truck.

But they did not have evidence to charge him with a DUI.

Christiansen pleaded no contest to several charges, including motor vehicle homicide and possession of an open alcohol container.

While the judge said Christiansen doesn't have to wear a monitor, he's still not allowed to drink alcohol and will be subject to testing.

He's also not allowed to drive.
