CHARLESTON, W.Va. (WV News) — The West Virginia Supreme Court of Appeals has denied a pair of motions, both to stay the initial ruling and to expedite the case, in an ongoing school vaccination lawsuit.

The lawsuit, which originated in Raleigh County, was brought by a group of parents based on their religious objections to the state's mandatory school vaccination policy.

Gov. Patrick Morrisey's issued an executive order in January interpreting a religious freedom law to extend to the vaccination policy.

But the state Board of Education has elected to continue following the current law and instructed county boards not to accept religious exemptions granted by the Department of Health under the order.
