SOMERSET, Pa. (WTAJ) — A Somerset County inmate convicted of killing a prison guard back in 2018 is seeking a new trial after being sentenced to death.

In a motion filed with the courts this week, Paul Kendrick's attorneys argue his sentencing should be thrown out due to misconduct during trial. They have appealed for a new trial, or at least a new penalty phase of the trial. They wrote in the motion that the jury that sentenced Kendrick to death was contaminated.

In this motion for post sentence relief, Kendrick's attorneys said they received an anonymous letter informing accusing some members of the jury went out to the bar together after spending a day listening to testimony. They said they have reason to believe the jurors discussed the case, which they should not have done.
