MERCER, Pa. (WKB) - The driver who police said was responsible for killing two people in a crash in May 2024 learned his sentence last week.
Damion Gearhart, 26, of Transfer, was sentenced to four to 10 years in prison, followed by one year of state re-entry supervision on Thursday. He was also ordered to pay fines and restitution as part of the sentence in the Mercer County Court of Common Pleas.
Investigators say on May 26, 2024, Gearhart was driving on Buckeye Drive in South Pymatuning Township when he hit a utility pole. Reports said that the crash resulted in the deaths of two passengers, 25-year-old David Helberg III and 29-year-old Brenton Tymchyshyn.
According to the criminal complaint, Gearhart was under the influence of alcohol with a BAC of .215%, well above the legal limit.
