COLUMBIA, S.C. (WIS) - A judge has ruled to dismiss a federal lawsuit filed by the NAACP against South Carolina Superintendent of Education Ellen Weaver and two Midlands school districts.

In a Monday filing, Judge Sherri A. Lydon threw out the lawsuit, saying that it lacked legal standing.

“The court recognizes that the issues raised are matters of public importance. But because Plaintiffs lack standing, the Constitution leaves their resolution to the democratic process rather than the federal courts,” her ruling read.

Lydon elaborated on the ruling, saying that the removal of the AP African American Studies course was not directly associated with the budget provisio, as the plaintiffs alleged in the July hearing and initial suit , but was tied to the alleged controversy of the course
