BUFFALO, N.Y. — In what may be the most Buffalo story of the week, the city of Buffalo is essentially suing itself.
Acting Mayor Chris Scanlon and Fillmore District Common Council Member Mitch Nowakowski filed a lawsuit against Comptroller Barbara Miller-Williams on Monday in Erie County Court.
Scanlon had floated the idea several weeks ago and confirmed he was talking with outside legal counsel.
The lawsuit is focused on whether or not the Comptroller has the authority to not go to the bond market for the capital budget projects that were approved by the Common Council.
In December 2024, the Council passed a $110M capital budget. However, in August of that year, Comptroller Miller-Williams warned her bond cap was $28M.
