WATERVLIET, N.Y. (NEWS10) -- The charges against the parents of the 9-year-old Watervliet girl who died have been dropped. The child was found in early August at a home on 2nd Avenue and pronounced dead at Samaritan Hospital.

Her cause of death was preliminarily determined to be chronic constipation. Her parents were initially charged with two counts of endangering the welfare of a child, but the Albany County district attorney said the charges have been dropped.

District Attorney Lee Kindlon said in a statement: "We decided not to criminalize poverty and punish grieving parents. We adjourned the case in contemplation of dismissal and worked with their attorneys and county agencies to get the pair set up with as many social services as they needed to get them through their tough time."
