The indictment charging a former associate municipal judge in Edinburg and her husband who is a police officer has been set aside, court records show.
State District Judge Fernando Mancias signed the order on Sept. 4.
This is the second indictment to be set aside against Katherine Garcia Perez, 49, and Daniel Perez, 56, charging them with possession of a controlled substance, “namely tetrahydrocannabinols, other than marihuana, in an amount of four grams or more but less than 400 grams.”
On Wednesday, Cameron County Administrative First Assistant District Attorney Edward Sandoval filed a motion requesting a findings of fact and conclusions of law from Mancias and asserting the state’s right to appeal his decision.
