Florida Attorney General James Uthmeier asked law enforcement and prosecutors on Monday to stop enforcing an open-carry ban after a Florida appeals court ruled that that ban was unconstitutional.

The ruling came Sept. 10 in a challenge filed by Stanley Victor McDaniels, who was convicted of openly carrying a gun on the Fourth of July in 2022 in Pensacola. It also came after years of legislative debate about potentially repealing the open-carry ban — a position supported by Gov. Ron DeSantis .

"Meaning that as of last week, open carry is the law of the state," Uthmeier said in a post on X.

"Because no Florida court will be any longer empowered to convict a defendant" for openly carrying a gun, Uthmeier asked prosecutors and law enforcement to "refrain from arresting or prosecuting law
