Delaware homeowners will soon be able to pass real estate without going through probate, as Delaware’s county recorders are preparing to roll out a new form allowing homeowners to transfer property directly to their heirs.
All three counties will begin recording Transfer on Death deeds using a standardized form on Dec. 4.
The effort follows Gov. Matt Meyer’s signing of the Transfer on Death Act on Sept. 5. The law allows homeowners to name a beneficiary who will automatically inherit real estate upon the owner's death. Until then, the owner retains full control and can sell, transfer or revoke the deed at any time.
