BAY CITY, MI — A registered sex offender from Ypsilanti is charged with sexually assaulting a person with an intellectual disability in Bay County.

Brian J. Smith, 45, earned his place on the sex offender registry in 1999 when he pleaded guilty to second-degree criminal sexual conduct with a relative in Washtenaw County. A judge in June of that year sentenced him to 29 months to 15 years in prison.

About 2:50 a.m. on Aug. 26, sheriff’s deputies responded to a Kawkawlin home after a woman called 911 to report her 20-year-old daughter had just been sexually assaulted. The caller told dispatchers her daughter awoke screaming, claiming Smith had just raped her, according to deputies’ reports obtained by MLive via the Freedom of Information Act.
