CHICAGO ( 25News Now ) - Illinois Attorney General Kwame Raoul has filed lawsuit against the Trump Administration, challenging what he calls the administration’s unlawful deployment of National Guard members to perform federal law enforcement functions.
The lawsuit alleges that the Trump Administration exceeded its authority in federalizing a state’s National Guard.
According to Raoul, 10 U.S.C. § 12406 permits the act under the following specific, limited circumstances: invasion, rebellion or if the federal government is unable to enforce federal laws.
Raoul said none of these legal requirements exist to justify federalization and deployment in Illinois. The federal government as is is able to enforce federal law in the state and federal courts are open.
