Javier Abeyta, 43, allegedly shot a woman in the head at close range Friday, and two days later she was pronounced brain dead.

Witnesses told police that Abeyta had been acting paranoid leading up to the alleged shooting and had made comments about killing someone. His sister said he had tried to shoot a friend in the back of the head, but the gun didn’t go off. And when Marissa Allen tried to take the gun away from Abeyta, he allegedly shot her.

According to an affidavit of probable cause, Abeyta admitted to shooting Allen to officers who had responded to the home shortly after the shooting occurred to serve a municipal warrant to another man. And according to one witness, he may have been under the influence of meth at the time of the shooting.
