BUFFALO, N.Y. — The federal death penalty trial for the Tops mass shooter is scheduled to start in August, and now we know when attorneys will have to turn in their list of potential witnesses by.
Those lists are due on Monday, and as of right now, that trial is scheduled to start with jury selection on August 17, 2026.

"It's called witness disclosure. Any witness that either side wants to call has to be named," said attorney John Elmore.
And it's a list that won't be made public, but will be extensive. It will also include potential experts and exhibits that the prosecution and defense want to enter into evidence. Attorney John Elmore represents some of the victims' families.
