A grand jury has decided not to file criminal charges against a Pemberton Township police officer involved in the fatal shooting of a 57-year-old Browns Mills man last year, authorities announced, Thursday, Nov. 20.

On Saturday, Oct. 19, 2024, a 911 call reporting smoke coming from a residence was received at 3:22 p.m., Attorney General Matthew Platkin said. The Pemberton Township Volunteer Fire Department and township police officers responded to a home on Woodland Avenue, Platkin said.

Responding officers were told that a man with a firearm, later identified as Marvin Taylor, was in the backyard of the property, Platkin said. Officers positioned themselves in a wooded area behind the residence and gave verbal commands ordering Taylor to drop the weapon, Platkin said.

Taylor exchanged gunfire with Officer Kyle McQueen of the Pemberton Township Police Department, Platkin said. Taylor was struck, and officers provided first aid before he was flown to Cooper University Hospital in Camden, Platkin said. He was pronounced dead later that day, Platkin said.

A firearm was recovered near Taylor after the shooting, Platkin said.

A 2019 law, N.J.S.A. 52:17B-107(a)(2), requires the Attorney General’s Office to conduct investigations of a person’s death that occurs during an encounter with a law enforcement officer acting in the officer’s official capacity or while the decedent is in custody. It requires that all such investigations be presented to a grand jury to determine if the evidence supports the return of an indictment against the officer or officers involved.
