The estate of the Coos County boy who wandered from home and died last year plans to sue the Oregon Department of Human Services for allegedly failing to protect the child from severe neglect .
The lawyer for Joshua James McCoy’s estate sent a letter to the state this month, stating plans to file a lawsuit and detailing what he described as the state’s mishandling of complaints about the boy’s welfare.
The 5-year-old went missing a year ago. His mother, Angela German, 44, told authorities she woke up from a nap she had taken with her son only to discover he was gone. The boy had autism, didn’t talk much and didn’t like to wear clothes, she said.
Four days later, his body was found 2 miles from home. Authorities determined that hypothermia and exposure contributed to his death.
