PHOENIX — The family of a man shot and killed by Phoenix police during a mental health crisis last month has filed a notice of claim against the city, alleging officers failed to de-escalate the situation before opening fire. The claim also alleges their father posed no risk to law enforcement, only himself.

On the morning of Oct. 2, 58-year-old Victor Altamirano’s daughters called 911 seeking help as their father experienced what they described as a suicidal breakdown.

“I need police here… my dad’s here and he’s having a scene and he’s being suicidal and he has a knife,” one daughter told dispatchers.
