MANITOWOC, Wis. (WBAY) - A Manitowoc County judge is going ahead with plans for a trial for Timothy Hauschultz, even though the prosecution and the defense both agreed the trial should be delayed for the man accused in the 2018 abuse and death of his 7-year-old nephew.

Hauschultz was charged almost seven years ago, in February 2019, accusing him of having a part in Ethan Hauschultz’s death in 2018. He was the boy’s court-appointed guardian.

Court records say at a motions hearing Thursday, the two sides told the judge Hauschultz’s son, Damian, is an essential witness who needs to be cross-examined in person.

But Damian, who is serving a 30-year sentence for first-degree reckless homicide in his cousin’s death, has invoked his 5th amendment right, and his counsel said he won’t be availa
