WAILUKU (HawaiiNewsNow) - A judge has denied a retired firefighter’s request to dismiss his continual sex abuse of a minor charge.
Court documents state that retired Maui Fire Department battalion chief Shawn Rogers allegedly abused a 12-year-old child in 2019, which went on for three years.
Rogers was charged with sex assault of a minor under the age of 14, which was first filed last year.
However, that case was dismissed because of misconduct during a grand jury proceeding.
A new grand jury reindicted Rogers in June.
Roger’s attorney, Brandon Segal, asked the judge again for a dismissal, citing the same kind of misconduct.
“You have a skewed presentation where the evidence is focused on the complaint witness’ story,” Segal said, “and they’re minimizing the defendant’s response to
