CARRBORO, N.C. (WTVD) -- Lawyers representing Duke Energy are hoping to get a lawsuit dismissed that was brought forward by the Town of Carrboro .

The town is taking on the big energy company in what the town calls "climate deception."

Last year Carrboro 's mayor and council voted unanimously to take on Duke Energy claiming the company deceived the town about the dangers of fossil fuels, contributing to millions of dollars in damages.

The town 's lawyers said the damages included years of storm damage, heating and cooling costs, and damage to roads and infrastructure from climate change.

While several other states have filed lawsuits over climate change, town leaders said this is among the first of its kind for a municipality in the country, to seek damages from an electric utility
