KALAMAZOO, MI – A federal judge has dismissed a lawsuit by Right to Life of Michigan that challenged a state Constitutional amendment providing the right to abortion.

Right to Life of Michigan and other plaintiffs showed no injury by the voter-approved amendment and thus had no legal standing to bring the lawsuit, U.S. District Judge Paul Maloney in Kalamazoo said.

He granted a defense motion to dismiss the case.

Nearly 57 percent of voters backed Proposal 3 in November 2022.

Abortion opponents named Gov. Gretchen Whitmer, Attorney General Dana Nessel, and Secretary of State Jocelyn Benson as defendants as they sought to halt access to abortion in Michigan.
