BOWLING GREEN — A Toledo man who pleaded guilty to a reduced charge after an appellate court vacated his rape conviction for an assault last year received a maximum sentence Monday from a Wood County judge.

Kenton Trayvon Diaz, 25, who had already served just short of 2½ years of his nine-year sentence after being convicted of rape at trial, is now slated to spend another 2½ years behind bars under the 60-month sentence Judge Mary “Molly” L. Mack handed down in Wood County Common Pleas Court for third-degree sexual battery.

Defense lawyer Alex Smith, who asked the court to consider either a 30-month sentence — most of which Diaz would have served already — or probation, requested the appointment of appellate counsel toward the proceeding’s conclusion, presumably to appeal the 60 months J
