LENEXA, Kan. -- "Justified" was the ruling from Johnson County District Attorney Steve Howe regarding a police shooting in Lenexa earlier this year that left 25-year-old Jose Enrique Cartagena-Chacon dead.

The deadly shooting happened in June at a Lenexa apartment complex.

Despite video evidence, a police investigation, and official records from that day, the District Attorney’s office and Chacon’s family have two very different accounts of what happened.

“Clearly, you see the officer backing up and executing this guy by shooting him in the back of the head,” said Thomas Bowers, an attorney representing the family.

“It’s protect and serve — not protect and execute.”

According to the DA’s office, Lenexa police were responding to an armed disturbance call.
