EVERETT, Mass. —

A 13-year-old immigrant, whose family lives in Massachusetts, remains in federal custody at a juvenile detention facility in Virginia two weeks after his arrest.

"He asked me when he could come home," said the boy's attorney, Andrew Lattarulo.

Lattarulo said a judge ordered that his client remain in custody following a hearing on Wednesday.

"Arthur did actually ask to be heard," Lattarulo said. "He told the judge that he’s sorry about everything and the judge can forgive him, but by then the judge had already ruled."

The U.S. Department of Homeland Security has alleged the 13-year-old Brazilian teen had ties to the gang 33, a Brazilian criminal ring, in Everett.
