A Queens mother’s attempt to link her child’s leukemia to pesticide use at a NYCHA complex came to an abrupt end this week, after a state appeals court ruled she waited far too long to press the claim.
The ruling found that her notice of claim arrived nearly three years after the alleged exposure period, and the judges said she offered no valid explanation for the long delay, leaving the court no basis to let the case move forward.
The family moved into a NYCHA building in 2015. Three years later, the child was diagnosed with leukemia and underwent nine months of chemotherapy before returning to school.
