Some say any yahoo can run for high office in New Mexico. "Toby Smith" aims to prove them right.

He is a con artist or a prankster who has filed as a candidate for the U.S. Senate. This elusive Mr. Smith isn't going to Washington.

"Toby Smith" listed his address on documents for the Federal Election Commission as 3828 Piermont Drive NE in Albuquerque. That house was home to fictional character Walter White, protagonist of the television series Breaking Bad . Now the house is on the market with an asking price of just under $4 million.

I phoned David Christensen, one of the real estate agents involved in the sale. "There is no Toby Smith living on the property. There is no Toby Smith associated with the property in any way, shape or form," Christensen said.
