An Alabama man has been charged with capital murder during the sexual assault of another man over the weekend.

Montgomery police were dispatched just before 5 a.m. Saturday to a report of a person down in the 100 block of Dexter Avenue.

The victim, identified in court records as 59-year-old David Crowe, was pronounced dead on the scene.

Lt. Tina McGriff on Monday identified the suspect as 51-year-old Barry Andre Freeman.

Charging documents against Freeman say the Montgomery man is charged with capital murder during rape/sodomy.

The deposition states that Freeman made sexual advances on the victim, which Crowe refused.

Freeman then struck Crowe in the throat with his fist, rendering the victim unconscious, records state.
