A 51-year-old Amherst man was sentenced to 2½ to 5 years in state prison after being convicted of theft by deception for his role in securing a $962,000 loan for the now-defunct White Birch Brewing, the New Hampshire Attorney General’s Office announced.
David Herlicka will serve two concurrent sentences for his convictions for theft by deception and conspiracy to commit theft by deception. He was also sentenced to 3½ to 7 years for securities fraud, but that sentence is suspended until 10 years after his release, officials said.
Herlicka, who was convicted by a Hillsborough County Superior Court North jury on Oct. 30, was also ordered to pay outstanding restitution.
